Terms & Conditions

Last updated: October 15, 2026

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern the services provided by Protecto Painters LLC ("Protecto Painters," "we," "us," or "our") to our customers ("you" or "Customer"). By requesting an estimate, accepting a quote, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. Please read them carefully.

2. Services

Protecto Painters provides residential and commercial painting and related services, which may include interior and exterior painting, cabinet painting, surface preparation, drywall and crack repair, priming and sealing, pressure washing, and deck, fence, and shed painting or staining. The specific scope of work for your project will be described in your written estimate or proposal.

3. Estimates & Quotes

We provide free, written estimates based on a visual inspection of the project site and the information you provide. Unless otherwise stated, estimates are valid for thirty (30) days from the date issued. The final price may change if actual conditions differ from those observed at the time of the estimate, if the scope of work changes, or if hidden conditions (such as water damage, mold, rot, or inadequate existing surfaces) are discovered once work begins. We will communicate any such changes to you before proceeding.

4. Pricing & Payment

Unless otherwise agreed in writing, payment is structured as fifty percent (50%) due upon acceptance of the estimate to schedule and begin the work (the "deposit"), with the remaining fifty percent (50%) due upon completion of the project. For larger or commercial projects, a separate payment schedule may be agreed upon in writing.

The minimum project amount we accept is $1,000. Accepted payment methods will be provided at the time of booking. Balances not paid when due may be subject to late charges and collection costs to the extent permitted by law. Financing options may be available — please ask us for details.

5. Scheduling & Access

We will schedule your project and make reasonable efforts to meet agreed-upon start and completion dates. However, all timelines are estimates and may be affected by weather (particularly for exterior work), material availability, project conditions, and other factors beyond our control. You agree to provide safe and reasonable access to the work areas during scheduled working hours.

6. Customer Responsibilities

Before work begins, you agree to: remove or relocate furniture, valuables, wall hangings, and fragile items from the work areas (or arrange for us to do so, which may incur additional charges); secure pets; provide access to water and electricity; and disclose any known hazards, such as lead-based paint, asbestos, mold, or structural issues. We are not responsible for damage to items left in the work area that should have been removed or protected by the Customer.

7. Color & Material Selection

You are responsible for approving all colors, sheens, and finishes before application, and we offer color consultations to assist you. Once a color is approved and applied, repainting due to a change of preference will be treated as additional work subject to a separate charge. Minor variations in color, sheen, and texture may occur and are normal, particularly between different surfaces, paint lots, and lighting conditions. We primarily use premium products from Sherwin-Williams and Benjamin Moore.

8. Change Orders

Any changes to the agreed scope of work must be documented in a written change order and may affect the project price and timeline. Additional work will not begin until the change order has been approved by both parties.

9. Warranty

Protecto Painters provides a workmanship warranty of one (1) to three (3) years, depending on the project type and scope, as specified in your estimate or proposal. This warranty covers defects in our labor — such as peeling, blistering, or flaking — that result from improper application under normal conditions. Manufacturer warranties on paint and materials are provided by the manufacturer and are separate from our workmanship warranty. To make a warranty claim, contact us using the information below.

10. Warranty Exclusions & Limitation of Liability

Our warranty does not cover, and we are not liable for, conditions beyond our control, including but not limited to: normal wear and tear; damage caused by settling, structural movement, or cracks in the substrate; moisture intrusion, leaks, flooding, or water damage; mold or mildew; damage from abuse, neglect, accidents, or improper maintenance; surfaces previously painted or prepared by others; failure of pre-existing coatings; fading or color change due to sun exposure; and acts of nature.

To the maximum extent permitted by law, Protecto Painters' total liability for any claim arising out of or relating to our services shall not exceed the amount paid by you for the specific services giving rise to the claim. We shall not be liable for incidental, consequential, special, or indirect damages.

11. Insurance & Bonding

Protecto Painters LLC carries general liability insurance and workers' compensation coverage, and is bonded. A certificate of insurance is available upon request.

12. Cancellation & Rescheduling

You may cancel or reschedule your project by contacting us as early as possible. If you cancel after materials have been purchased or work has begun, your deposit may be applied to cover materials already purchased and labor already performed. We reserve the right to reschedule work due to weather or other conditions beyond our control.

13. Photographs & Marketing

We may photograph completed work for quality control, documentation, and marketing purposes, including our website and social media. Photographs will not include identifying personal information without your consent. If you prefer that we not use photographs of your project, please notify us in writing.

14. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law principles. Any dispute arising out of or relating to our services will first be addressed through good-faith communication between the parties. If a dispute cannot be resolved informally, any legal action shall be brought in the state or federal courts located in Colorado.

15. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time you accept an estimate or engage our services will apply to your project. The most current version will be posted on our website.
